    Saw this in the local paper this morning.

    "A 40-year-old bicyclist riding home from work in the bicycle lane was hit from behind... The bicyclist and his bicycle were dragged by the car about a half mile... Officials believe alcohol was involved."

    rear-ended in the bike lane and dragged for half a mile!!! wtf?!?!? assuming they've got the right guy in custody, if he fights the forthcoming DUI charge i hope they charge him with attempted murder.

    if he has any prior DUIs, and this being CA, can they get him for attempted murder anyway?

    anyone with info is asked to call a 714 number... that's near LA, right? i'd like to think that if someone dragged a bike rider for half a mile anywhere in that area code, they'd get some positive IDs on the vehicle. maybe they did, but it's not clear from the article.

If that driver is caught he'll probably try to make the same claim that Bertonatti made when the police finally pulled his a$$ over, i.e. "no I didn't you're lying, the police are always lying." That and he'll probably fight them on the blood draw. Although at this point what would be the point of doing a blood draw?

    He managed to make it home before the police caught up with him. Police suspect alcohol was probably involved.

    If he was drunk and first year law school student could get him off the drunk driving charge. At the moment he is charged with a felony hit and run. One must really question when a hit and run ends and an attempt to kill someone by continuing dragging them down the road begins...

    There are just too many immature, irresponsible asshats in the this world. This one should be dragged under a car from awhile to taste what that is like then sent to prison for a few years to contemplate his actions.

A couple of SoCal district attorneys, including the one in Orange County, are forcing people convicted of DUI to sign an agreement wherein the drunk agrees that he/she is aware of the danger they pose when driving drunk as a condition of parole. When the drunk subsequently drives drunk and causes a death the drunk is prosecuted for murder. The signed agreement makes it clear that they were aware that there was a strong likelihood that someone would die if they continued to drive drunk. I'd like to see this procedure gain momentum. If the driver who did this is shown to have been drunk and has a prior in Orange County, he may be spending a long time behind bars.
